You Have Rights at Work

Suffering discrimination at work can be a confusing experience. Whether the discrimination was subtle or overt, it can be difficult to know what to do next. You may be afraid of losing your job if you complain to your supervisor or human resources. However, it is against the law for an employer to fire you for making such complaints.

If you have questions about discrimination, it is best to discuss them with an employment law attorney. Too many people rely on misinformation from co-workers, friends and family. Contact Walker, Hamilton & Kearns, LLP, instead. Our experienced workplace discrimination lawyers can discuss your claim and advise you of your rights. To schedule a free consultation, please call us today.

Report the Discrimination and Contact Us

The first step in a discrimination case is to report it to your employer and follow the process outlined in your employee handbook. We can represent you throughout your employer’s complaint/grievance process. We can also take your case to Equal Employment Opportunity Commission (EEOC) and California Department of Fair Employment and Housing (DFEH) hearings, as well as state or federal court proceedings.

State and federal laws prohibit discrimination in any part of the employment process such as hiring, performance ratings, demotion, non-promotion, disciplinary actions, benefits and training denials, suspension and termination. Despite these laws, however, discriminatory actions occur at workplaces every day over issues such as:

  • Disability
  • Race, ethnicity and national origin
  • Age (over 40)
  • Sex, including sexual harassment, sexual orientation discrimination and hostile work environment
  • Pregnancy
  • Genetic information
  • Religion
  • Military service

Employers are also not allowed to discriminate on the bases of participation in the Family and Medical Leave Act (FMLA), filing a workers’ compensation claim, reporting dangerous conditions, refusing to participate in illegal activity, whistleblowing, or providing evidence in another employee’s discrimination, workers’ comp or whistleblowing case.
