How Do I Get Started?
You must report sexual harassment to your employer and follow the company’s complaint/grievance procedure before taking legal action. You can then file a complaint with the California Department of Fair Employment and Housing (DFEH) or Equal Employment Opportunity Commission (EEOC). Feel free to contact us at any time to learn more about your rights.
You can be sexually harassed in the workplace by supervisors, co-workers or third parties of the opposite or same sex. Sexual harassment can include issues such as:
- Sexually offensive remarks, jokes, e-mail messages, websites or photographs
- Sexual advances and threats
When an employer allows a culture of sexual harassment to become so pervasive that it affects your ability to do your job, it may be considered a hostile work environment. This is also a type of sex discrimination.
In addition, employers are not allowed to base employment decisions on sex, gender, gender identification, or sexual orientation. This includes hiring decisions and:
- Disciplinary actions, demotion/non-promotion or termination because you are biologically a man or woman
- Disciplinary actions, demotion/non-promotion or termination because you reject sexual advances at work
- Disciplinary actions, demotion/non-promotion or termination because you are, or are suspected of being, lesbian, gay, bisexual or transgender
